Article 1 – About the Site
The website accessible at https://queer.paris (hereinafter "the Site") is published and operated by Alain Bartolo, acting within Omnicité SCOP SA (Paris Trade Register no. 492 196 209), whose registered office is located at 70, rue Amelot, 75011 Paris, France (hereinafter "the Publisher"). Article 2 – Purpose and Scope
These Terms of Use (hereinafter "ToU") define the terms and conditions governing access to and use of the Site by any user (hereinafter "the User") as well as by any event organiser publishing content on the Site (hereinafter "the Organiser"). Accessing the Site constitutes full and unreserved acceptance of these ToU. The Publisher reserves the right to amend these ToU at any time; amendments take effect upon publication on the Site. Users are responsible for reviewing them regularly.
Article 3 – Access to the Site
The Site is freely accessible, from any location, to any User with an internet connection. All costs incurred by the User to access the Site (hardware, software, internet connection, etc.) are their sole responsibility. The Publisher shall not be held liable for any damage of any nature resulting from a temporary or permanent unavailability of the Site, and reserves the right to interrupt or modify access to the Site at any time without prior notice.
Article 4 – Intellectual Property
4.1 Publisher's Content
All elements of the Site created by the Publisher (structure, graphic design, logo, presentation texts, infographics, etc.) are protected by copyright and, where applicable, by related rights, in accordance with the provisions of the French Intellectual Property Code. Any reproduction, representation, modification, publication, transmission, distortion or use, in whole or in part, of these elements, by any means whatsoever, without the prior written authorisation of the Publisher, is prohibited and would constitute an infringement punishable under Articles L. 335-2 et seq. of the French Intellectual Property Code.
4.2 Content Published by Organisers
queer.paris allows third-party organisers to publish events, including images, visuals, descriptive texts and booking links (hereinafter "Organiser Content"). Such content is published under the sole responsibility of the Organiser who submits it.
By publishing an event on queer.paris, the Organiser expressly declares and warrants that they: - hold all intellectual property rights over the content they submit (texts, images, visuals, logos, etc.) or have obtained all necessary authorisations and licences for its use and publication on the Site; - ensure that such content does not infringe any third-party rights, including copyright, image rights, trademark rights or related rights; - ensure that such content contains no unlawful, defamatory, abusive or public-order-violating material.
The Publisher does not carry out systematic prior verification of the rights attached to Organiser Content. In accordance with Article 6 of French Law no. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN), the Publisher benefits from hosting provider status in respect of content submitted by Organisers and shall not under any circumstances be held liable for any infringement of a third party's intellectual property rights resulting from the publication of such content, provided it had no actual knowledge thereof or acted promptly to remove it upon notification.
In the event that a disputed piece of content is reported (infringing content, image used without authorisation, etc.), the Publisher undertakes to remove it as soon as possible following notification. Reports may be sent to: contact@queer.paris, specifying the nature of the disputed content, the URL of the relevant page, and supporting evidence of the claimant's rights.
The Organiser agrees to indemnify and hold harmless the Publisher against any claim, legal action or judgment arising from an infringement of a third party's intellectual property rights in connection with content they have submitted, including legal fees and court costs.
The Publisher reserves the right to remove, without prior notice or compensation, any Organiser Content that has been reported as disputed, of which it becomes aware, or that does not comply with these ToU.
Article 5 – Cookies, Trackers and Analytics
5.1 Google Analytics 4 (GA4)
The Site uses Google Analytics 4 (GA4), an audience measurement service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States. This service places cookies on the User's device in order to collect anonymised statistical data relating to browsing activity (pages visited, session duration, traffic source, interactions, etc.). In accordance with the General Data Protection Regulation (GDPR) and the recommendations of the French data protection authority (CNIL), data collected via GA4 is used under the following conditions: - The IP address anonymisation feature is enabled. - Data is processed on the basis of the User's prior consent, collected via a cookie management banner. - Data may be transferred to servers located outside the European Union, including in the United States, under standard contractual clauses approved by the European Commission.

5.2 Advertising – Webgains
The Site integrates the Webgains affiliate advertising network, operated by Webgains Ltd, 6th Floor, One London Wall, London, EC2Y 5EB, United Kingdom. In this context, Webgains places third-party cookies on the User's device in order to: - Track conversions and clicks on advertisements displayed on the Site. - Remunerate affiliate partners. - Tailor advertisements to the User's interests (profiling or targeting cookies).
These cookies are placed under the responsibility of Webgains. Users are encouraged to consult Webgains' privacy policy at: https://www.webgains.com/public/en/privacy-policy/
The User's consent is collected prior to the placement of these cookies via our consent management tool (cookie banner). In the absence of consent, no Webgains advertising cookies are placed.
5.3 Consent Management
On the first visit, an information banner relating to cookies is presented to the User, allowing them to: - Accept all cookies. - Refuse non-essential cookies. - Configure their preferences by category.
Users may modify their cookie preferences at any time by accessing their browser settings or via the cookie management tool available on the Site. Consent is stored for a maximum of thirteen (13) months, in accordance with CNIL recommendations.
Article 6 – Personal Data Protection
The Publisher undertakes to process Users' personal data in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and French Law no. 78-17 of 6 January 1978 on data processing, files and individual liberties, as amended.
Personal data collected via the Site is processed for the following purposes: - Managing the relationship with Users. - Audience measurement and Site improvement. - Delivery of personalised advertising content (subject to consent).
In accordance with Articles 15 to 22 of the GDPR, Users have the following rights: - Right of access to their personal data. - Right to rectification of inaccurate or incomplete data. - Right to erasure ("right to be forgotten"). - Right to restriction of processing. - Right to data portability. - Right to object to processing. - Right to withdraw consent at any time, without affecting the lawfulness of processing carried out prior to withdrawal.

Article 7 – Limitation of Liability
The Publisher takes all reasonable steps to ensure the accuracy and currency of information published on the Site. However, the Publisher does not guarantee the accuracy, completeness or timeliness of published information, particularly with regard to event details provided by Organisers (dates, times, venues, prices), the verification of which is the sole responsibility of the User.
The Publisher shall not be held liable for any direct or indirect damage resulting from access to or use of the Site, including unavailability, data loss, deterioration, destruction or any damage caused to the User's software or hardware.
The Site may contain hyperlinks to third-party websites. The Publisher has no control over such websites and accepts no liability for their content or privacy policies.
Article 8 – User Obligations and Conduct
Users agree to use the Site in compliance with applicable laws and regulations and with the rights of third parties. In particular, the following are prohibited: - Publishing any unlawful, defamatory, abusive, pornographic, child-exploitative, violent content, or content inciting hatred, discrimination or violence. - Infringing the intellectual property rights of the Publisher or third parties. - Collecting, without authorisation, the personal data of other Users. - Introducing viruses or any harmful software onto the Site. - Attempting to gain unauthorised access to the Site's computer systems.
Any breach of these obligations may result in civil and/or criminal proceedings.
Article 9 – Governing Law and Jurisdiction
These ToU are governed by French law. In the event of any dispute relating to the interpretation or performance of these ToU, the parties shall endeavour to reach an amicable resolution before resorting to legal proceedings.
Failing an amicable agreement, any dispute shall be submitted to the exclusive jurisdiction of the competent French courts, notwithstanding any plurality of defendants or third-party claims.
