TERMS AND CONDITIONS OF SALE

Effective from June 1, 2025

Article 1 – Purpose

These terms and conditions of sale (T&Cs) govern the contractual relationship between the company Omnicité Production, publisher of the queer.paris platform (hereinafter "queer.paris"), and any individual or legal entity (hereinafter "the Organiser") wishing to purchase paid promotion of an event on the website https://queer.paris. Any order implies full and unreserved acceptance of these T&Cs. Specific conditions may be agreed in writing between the parties and shall prevail over these T&Cs in the event of any contradiction.

Article 2 – Services offered

queer.paris offers LGBTQ+ event organisers paid promotion packages to increase the visibility of their events on the platform. These packages may include: priority positioning in listings, featured placement on the homepage, mentions in newsletters or on social media. The detailed characteristics of each package are presented at the time of ordering. queer.paris reserves the right to modify or update its offerings at any time, without affecting orders already confirmed.

Article 3 – Order and acceptance

An order is deemed definitively accepted once the Organiser has: selected the desired package on the platform; provided the information relating to their event; completed payment via Stripe and received payment confirmation. queer.paris reserves the right to refuse or cancel any order whose content is contrary to its editorial values or applicable law.

Article 4 – Pricing and VAT

Prices are displayed in euros, inclusive of all taxes (VAT included), at the time of ordering. queer.paris may update its prices at any time; the applicable price is that displayed at the time the order is confirmed. A breakdown of applicable VAT is included in the order confirmation sent electronically.

Article 5 – Payment terms

Payment is made exclusively online at the time of ordering, via the secure payment solution Stripe. Accepted payment methods are those offered by Stripe: credit and debit cards (Visa, Mastercard, American Express) and any other method enabled on the platform. Payment is debited immediately upon order confirmation. If payment fails, the order is not registered. queer.paris does not store any banking data. Transactions are processed securely by Stripe in accordance with PCI-DSS standards.

Article 6 – Service delivery

The event promotion is activated as soon as possible following payment confirmation, and no later than within 48 business hours. The exact duration and terms of the promotion are defined at the time of ordering. The Organiser is solely responsible for the accuracy of the information provided regarding their event (title, date, venue, description, visuals). queer.paris cannot be held liable for any errors or omissions in the information provided by the Organiser.

Article 7 – Right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to services that have been fully performed before the end of the withdrawal period, where performance has begun with the consumer's prior express consent. By placing an order on queer.paris and completing payment, the Organiser expressly acknowledges waiving their right of withdrawal once the promotional service has commenced.

Article 8 – Refunds and cancellations

Any confirmed and paid order is firm and final. No refund will be granted in the event of cancellation of the event by the Organiser, modification of information, or dissatisfaction with the results of the promotion. In the event of a proven failure by queer.paris to fulfil its obligations (complete failure to deliver the promotion attributable solely to the platform), a credit note or refund may be granted at the discretion of queer.paris.

Article 9 – Intellectual property

The Organiser warrants that they hold all rights to the content (texts, visuals, logos, etc.) submitted to queer.paris for promotional purposes, and indemnifies queer.paris against any third-party claims in this regard. By submitting such content, the Organiser grants queer.paris a non-exclusive licence to use, reproduce and distribute it on the platform and its communication channels (social media, newsletters) for the duration of the promotion. queer.paris retains all intellectual property rights over the platform, its design, source code and editorial content.

Article 10 – Confidentiality and personal data

Personal data collected at the time of ordering is processed by Omnicité Production in accordance with its privacy policy, available at https://queer.paris. It is used for order management purposes and, with the Organiser's consent, for communication purposes. Payment data is processed exclusively by Stripe and is neither stored nor accessible by queer.paris. In accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, the Organiser has the right to access, rectify, erase and obtain portability of their data by contacting contact@queer.paris.

Article 11 – Liability

queer.paris undertakes to implement all reasonable means to ensure the availability of the platform and the proper delivery of promotions. Its liability is limited to the amount of the relevant order. queer.paris cannot be held liable for indirect damages, loss of business or reputational harm resulting from the use of, or inability to use, the platform.

Article 12 – Force majeure

queer.paris cannot be held liable if the non-performance or delay in performance of an obligation results from a force majeure event within the meaning of Article 1218 of the French Civil Code, including: widespread Internet outage, cyberattack, administrative decision, or natural disaster.

Article 13 – Amendments to the T&Cs

queer.paris reserves the right to amend these T&Cs at any time. Amendments take effect upon publication on the platform. Orders placed prior to any amendment remain governed by the T&Cs in force at the time of their confirmation.

Article 14 – Governing law and jurisdiction

These T&Cs are governed by French law. In the event of a dispute, an amicable resolution will be sought as a priority. Failing that, the dispute will be brought before the Paris Commercial Court (Tribunal de commerce de Paris), even in cases involving multiple defendants or third-party claims.
